This company used to do my anodizing. I wonder if I can get back all the money they charged me for "Hazardous Waste Disposal Fee"http://www.ydr.com/newsfull/ci_5799707

thanks for posting this.
i once worked for a shop, the owner would take all the used oil and cutting fluid, and dump it in the parking lot pot holes, then he would put a die block on the fork lift and push stone over the oil. the oil would be all over the parking lot, it got all over our tires and when it rained it would make beautiful
rainbows.

Do you have invoices from them that split this out as a separate item? If they were charging a separate fee for this service and did not actually do what the fee was for surely that means including the fee in the invoice was fraudulent?

I've worked for several shops that had some hinky ways of operating, including the disposal of waste oils, paying payroll taxes (or I should say, not paying), paying overtime in cash, if you bought tools and gave them the receipts, ghost employees on the payroll, why, I don't know, certified material not being the actual stuff, just all kinds of stuff. At least now I know better, and if a shop I am working for starts to get a little flaky about stuff, AMF.

I pulled their invoices out of my filing cabinet. Each invoice has a line item charge " Enviromental Fee" which was 10% of the Labor Fee. I'm guessing the company probably did 500K a year. After doing some quick math they pocketed 50K a year for 5 years = $250,000.00 The 6 O'clock news said they are facing 10 years in the clink.

Don't know if this helps, but here in the UK if you were charged for something illegaly you can sue and get it all back for the previous six years. You can also charge them interest on this at the Royal Bank of Scotland base rate (but you can't compound the interest.

I should definately seek legal advice on this. You will also be able to reclaim your legal fees.

Dont know where you stand if they are bankrupt though.

There are instances of companies that are in the waste disposal business that illegally dump waste. The money they made vanishes. Do you know where they get the money to pay for cleanup? They get it from the companies that originally paid to dump the waste legally. Sucks, they get to pay for it twice.

The laws for waste disposal go like this.
The waste your company produces is yours from start to finish.
If you pay a disposal company to haul it off...it's still yours, and your responsibility,all you did was hire someone to transport it.
If somehow it leeches into a water supply...it's yours.
It's up to you to make sure it is disposed of legaly.
If the disposal company dumps it illegaly,it's your responsibility to clean it up and your decision as to whether you want to sue the company for refund.
It's best to have a contract with the disposal company that outlines the disposal method you require...It gives you something to fall back on in a lawsuit.

it gets worse
in my state if you sell clean fluids
you are responsible for where and what the customer does with it
so if joe blow dumps it gets caught and they ask where they got it from
well you pay for the cleanup
