Unhappy Just so you know.....

While back I posted a thread complaining about CNCParts.com and how they screwed us on an FMDC board repair for 1250.00. The card is at EMI and I just got a call after their diagnostic and the card is still in fact broken and being repaired. CNCParts did nothing to it. Be warned they (CNCParts) would not honor their warranty after ONE DAY because they said "something else must be wrong with the mill". Thats all I got to say about that except I want my $1250 back.

Try suing them in your local small claims court. Chances are, they won't show for the trial due to the "piddly" amount involved.

Result: default judgement.

A default judgement will allow you to turn them over to a collection agency which always makes for an interesting day.

If you can't get your money back, get even, get retribution and get a chuckle out of making their life a bit as miserable as they made yours.... ALong the way, you'll have some fun learning what you can do with the legal system.

My favorite is to get your judgement. Then file a claim against any and all property they own as a company or individualy.
That way they can not sell anything without settling with you first. Sometimes you have to wait a while but oh the funny look on their face when they try to sell something is priceless. Then you take a year or two to release the claim as those legal matters sometimes take time. You May even be able to sell your claim to someone (lawyers) as an investment, as you are allow to collect interest on judgement claims. (:~)= Terry

They are in Texas and Im not. Not gonna fly out there to go to court. Not interesred in throwing good money after bad as far as legal fees. If I could do something I would but I know even after a judgement they still wouldnt pay. Dont know how they sleep at night.

My old Granddaddy use to say, never let a horse theif sleep.
If no one every chases them they sleep quiet well. Maybe one of them Texas Lawers needs some pocket change. TP

Check your state laws as there is reciprocity in some instances. Call your local court to see what the laws are regarding small claims - you might be surprised.

Check federal law too as that is what governs interstate commerce. You can file pro se in federal court and many times the filings are ALL by mail. You'd be amazed at what you come up with via google searches.

If they used the mail to defraud you (as in if you sent them a check by mail - that is federal). Check with the post office as they can guide you on that sort of thing. Do a google for "mail fraud" and see what sort of statutes you kick up....

call the Texas attorney generals office and file a complaint. A $1200 bogus bill may fit into the category of grand larceny - especially if you can get documetation from an "expert repair center" outlining what was really wrong that they didn't fix and then stiffed you that amount.

Ultimately, it will come down to the fact whether your want the money back more than they want to keep it....

Check (Money order....they insisted) was sent FedX. We filed a complaint a while back via email to the Texas AG. Have not heard anything. Make no mistake I am pissed about this. Im just not willing to spend one more dime on that company. EMI (the good guys) also told me that the card had the wrong clock crystal in it when they were first trying to test it. Outside of that they replaced 5 or 6 chips that I can see.

I know it's a hastle but you can't just let them walk if you know they did you wrong. That would be just as big of a crime!

Sorry... nothing I did was a crime. Out 1250. Not gonna spend another thousand in legal fees. Not going to spend hours on the phone pleading my case. Not another dime. Look at it this way. Im saving you money with the warning about them.

Laser check to see if you have any law colleges near by, I am sure some up and coming lawyer would work on a commision/ with their proffessor's help, to help you recover some of your money and them make some money to boot. Just a thought. Terry

this place is the best in my opinion. real nice and very helpful with very quick turnaround. i highly recommend if you need any type of boards repaired. plus they send you a box of cookies for christmas
